The bankruptcy process starts with a telephone call from you to our office to speak with me, Christopher German. During this initial telephone call, I will be asking you a few questions to get an idea of how I can help you and how much your bankruptcy will cost. We offer low cost payment plans. It is important that you get a jump on the bankruptcy process as soon as possible.
At this time I will set your goals in filing for bankruptcy. You may simply want to get out from under overwhelming debt, stop a garnishment, avoid repossession, save your home from foreclosure or a combination of all of these. As a bankruptcy lawyer, I want to find out how to best get you a fresh financial start.
Once you and I settle on the price of your bankruptcy and you decide to move forward, I will send you a Fee Agreement, which you will return with your retainer. You will then download and fill out your Bankruptcy Worksheet. This worksheet contains questions regarding ALL of your assets and debts. It is very important that you list ALL your assets and debts. Only you know what they are. Once you return the Bankruptcy Worksheet I will review it and begin preparing the Bankruptcy Petition. We will then set-up our next phone consultation.
Before filing a Bankruptcy Petition in Aurora you must first complete a “credit counseling course” and receive a certificate of completion. This is typically an easy process and is easy to complete. It can be done at your convenience and in the comfort of your own home. It takes about an hour or less and can be done on the internet. Most of our clients enjoy the credit counseling and find it to be very informative. Do not worry about this step – I can assist you in finding an approved credit counseling agency for a Aurora bankruptcy filing.
At the second phone consultation we will analyze your personal property, income, expenses, real estate issues and financial affairs so that I can “protect” your personal property and real estate and determine which is more appropriate, a chapter 7 bankruptcy or a chapter 13 bankruptcy.
After that, I finalize your bankruptcy petition. I will send you a draft of the petition which you will review from the comfort of your own home. You may or may not have revisions that need to be completed. Once we finalize the details, I will file your Bankruptcy Petition with the United States Bankruptcy Court District of Colorado, located in Aurora.
The Bankruptcy Court will then schedule what I refer to as a “341.” (341 Meeting of Creditors). Unless you are filing a Chapter 13, this is normally the only time you will have to appear in front of anyone. There is no need to be nervous about this meeting. You are not going in front of a judge and you are not going into a courtroom. The 341 is a somewhat informal meeting where you sit down at a small table with me and a bankruptcy trustee. Your creditors normally do not show up at this hearing.
At this meeting you are asked approximately 10 questions and normally these are the same questions I asked you before the bankruptcy petition was filed. Again, I will be sitting right next to you at this meeting, you will not be there alone.
That is nearly the end of the bankruptcy process.
You MUST complete a SECOND credit counseling class called “Debtor Education” after your bankruptcy petition is filed. This second class MUST be completed NO LATER than 45 days after your 341 meeting of creditors. This is typically a simple process and can be completed in about an hour or less either by telephone or by internet from the comfort of your own home. Again, you do not have to sit through any lengthy classroom lectures or prepare for it in any way. It is nothing to be worried about. Normally you use the same company that provided your Credit Counseling Certificate.
Typically, this is all there is to be expected when filing for Bankruptcy in Aurora. I do most of the work and will guide you at every step in the process. Once everything is competed, unless you filed a Chapter 13 Bankruptcy, you can typically expect to receive your Bankruptcy Discharge approximately 60 days after the 341 Meeting of Creditors date. This “Chapter 7 Bankruptcy Discharge or Chapter 13 Bankruptcy Discharge” means that you have been discharged from your debts and are no longer required to pay your dischargeable debts.
